Terms & Conditions

  1. Information on how to enter this competition forms part of the terms and conditions of entry. Entry into this competition is deemed to be an acceptance of these terms and conditions.
     
  2. The Promoter is Infoxchange ABN 74 457 506 140 of 33 Elizabeth St, Richmond, VIC 3121. Phone: (+613) 9614 7400 (Promoter).  This competition is being run in association with Australian Postal Corporation (ABN 28 864 970 579) (Australia Post).
     
  3. Entry into this competition is free of charge. Entry is open to all eligible Go Digi Network Partners, excluding Infoxchange and Australia Post employees, suppliers, retailers, agencies or companies associated with this competition.
     
  4. The competition commences at 9:00 am AEST on Tuesday 10th of January, 2016. Entries close at 11.59pm AEST on Friday 27th January, 2017 (Competition Period)
     
  5. The competition will be advertised via:
    1. an e-newsletter sent to current Go Digi subscribers;
    2. the Go Digi platform and Go Digi social media; and
    3. Australia Post and Infoxchange channels.
       
  6. To enter the competition, entrants must:
    1. Complete the Go Digi Feedback Survey; and
    2. follow the instructions set out in the survey to enter the competition.
       
  7. Without limiting clause 6 above, entries must include:
    1. Individuals name and e-mail address;
    2. an answer to the following question (in 25 words or less) which also addresses the competition criteria set out in the Website: “Tell us in 25 words or why digital literacy and digital inclusion is important to you”; and
    3. any additional information as required by the Promoter.
       
  8. Entrants may only enter once. Entries must be completed and sent by email to [email protected] and received by 11.59pm AEST on Sunday 27th January 2017.  Entries are deemed to be received at the time they are received by the Promoter’s database and not at the time of submission by the entrant. 
     
  9. Entrants are responsible for the accuracy of the information provided in their entry and are aware that they may forfeit their right to claim a prize if they are the winner and the Promoter and/or Australia Post cannot contact them because the entrant's details are inaccurate or incorrect.
     
  10. Each entrant warrants that their Entry:
    1. is their own original creation and work;
    2. does not include any content that contravenes any law, which may be defamatory or in contempt of court, is obscene, offensive, discriminatory, indecent, otherwise objectionable or inappropriate or makes any improper or inappropriate invasion of the privacy of any person; and
    3. does not infringe the rights (including copyright) of any person.
      ​Each entrant agrees to indemnify the Promoter and Australia Post in relation to any loss or damage resulting from any breach of warranty set out in these conditions of entry.
       
  11. To the extent permitted by law, each entrant hereby assigns to the Promoter all intellectual property rights (including copyright) in their Entry. If any intellectual property rights (including a moral right) cannot be assigned, each entrant hereby grants to each of the Promoter and Australia Post an irrevocable and exclusive licence in perpetuity to use, copy, distribute, publish, broadcast, modify, adapt and otherwise exploit the entry for any purpose, together with all ancillary rights.  The Promoter and Australia Post may exercise all such rights without any fee being paid to the entrant.
     
  12. Entrants under 18 years old must have their parent's/guardian's permission to enter this competition and/or to accept the prize.
     
  13. Neither the Promoter nor Australia Post accepts any tax liability incurred as a result of any participation in the competition.
     
  14. The Promoter's and Australia Post’s decision in respect of all aspects of this competition are final and no correspondence will be entered into.
     
  15. Neither the Promoter nor Australia Post accepts any responsibility for any late, lost or misdirected entries, whether due to error, omission, transmission interruption, communications failure or otherwise. Neither the Promoter nor Australia Post has any control over communications networks or services, the internet or other technology used or required to enter the competition and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter and Australia Post are not liable for any consequences of user error including (without limitation) costs incurred.  Entrants who enter using multiple email addresses or aliases may be disqualified. 
     
  16. The Promoter and Australia Post may (but are not obliged to) determine at any time, in their absolute discretion, whether or not to publish any entries on the Promoter’s or Australia Post’s website and/or Facebook or Twitter Pages, remove any entries once published, or amend, edit or modify any entries (or any part thereof), or disqualify or invalidate any entry including (without limitation) if the Promoter or Australia Post is of the view that it does not comply with these conditions of entry.
     
  17. Up to 7 prizes will be awarded to eligible entrants with a prize pool of 11 Samsung Galaxy Tab 3 tablets.
     
  18. 7 best valid entries as determined by a panel of representatives of the Promoter and Australia Post, will be allocated prizes as follows:
    1. A prize of one Samsung Galaxy Tab 3 device will be awarded to five entrants in the 'Learner' survey
    2. A prize of five Samsung Galazy Tab 3 devices will be awarded to one entrant in the 'Network Partner' survey
    3. A prize of one Samsung Galaxy Tab 3 device will be awarded to one entrant in the 'Mentor' survey
       
  19. This is a game of skill; chance plays no part in determining the winners.  Entries will be judged by a panel of representatives of the Promoter and Australia Post based on the most creative, engaging and impactful ideas set out in Entry Emails. Entries will be judged at the office of Australia Post (111 Bourke Street, Melbourne, Victoria, 3000) during the fortnight commencing 30th of January 2017. The prize winners will be notified by email prior to 17th February, 2017 and the arrangement of prizes will be communicated the week commencing 20th of February, 2017.
     
  20. Prizes cannot be exchanged or refunded and prize winners shall not contact Australia Post or Infoxchange about the device or the competition after the prize is awarded.
     
  21. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person (including without limitation a winner) who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate. 
     
  22. If a winning entry is deemed not to comply with these conditions of entry, the entry will be discarded and the prize will be awarded to the entrant who submitted the next best valid entry (who has not already received a prize).
     
  23. Entry into the competition shall be deemed acceptance of these conditions of entry and is deemed approval by the winners to use of their names and photographs for publicity purposes.  The Promoter and Australia Post may at their discretion refuse to award any prize to any entrant who fails to comply with these conditions of entry.
     
  24. The Promoter, Australia Post and their contractors, employees, agents and companies, will not be liable for any claims, losses (including but not limited to indirect or consequential loss), damages, injuries, death, costs or expenses suffered, sustained or incurred (whether or not arising from any person’s negligence) as a result of, arising out of or in any way connected with this competition and/or accepting or using any prize, except for any liability that cannot be excluded by law (in which case such liability is limited to the minimum allowable by law).  Nothing in these conditions restricts, excludes or modifies or purposes to restrict, exclude or modify any statutory consumer rights under any applicable law, including the Competition and Consumer Act 2010 (Cth).
     
  25. If there is an event beyond the Promoter’s or Australia Post’s reasonable control which prevents or hinders the proper conduct of this competition or the Promoter’s or Australia Post’s ability to deliver the prizes, then the Promoter and/or Australia Post may in their discretion cancel, modify or suspend the competition, invalidate any affected entries, or change the prizes.
     
  26. The Promoter and Australia Post may communicate or advertise this competition using Facebook.  However, the competition is in no way sponsored, endorsed or administered by, or associated with, Facebook.  Entrants are providing their information to the Promoter and Australia Post and not to Facebook.  Each entrant completely releases Facebook from any and all liability.
     
  27. Privacy notice: The information requested to enter the competition is being collected by Australia so that you can enter and we can administer this competition.  Your information may be passed to third parties involved with this competition including Infoxchange.  Without this information, we are unable to process your entry.  Your personal information is managed in accordance with Go Digi’s privacy policy. This sets out how you may seek access to and correction of your personal information and how to make complaints. A copy is available at https://www.godigi.org.au/privacy.  Infoxchange may only disclose the information provided by you if required or authorised by law, or in accordance with our Privacy Policy. All personal information received by Australia Post will be managed in accordance with paragraph 27 below.
     
  28.
